1. APPROVE or DENY to adopt the ordinance for the petition filed by Mid South Golf, LLC., owners, represented by Clearpoint Engineers, to change the zoning classification of certain property located at 6170 Highway 98 West (newly annexed), from R-1A (Single-Family Residential) District, to B-5 (Regional Business) District; Hattiesburg Planning Commission recommended to DENY on August 8, 2007.
2. APPROVE or DENY to adopt the ordinance for the petition filed by Mid South Golf, LLC., owners, represented by Clearpoint Engineers, to change the zoning classification of certain property located at 254 Gravel Pit Rd. (newly annexed), from R-1A (Single-Family Residential) District, R-2 (Two-Family Residential), to B-5 (Regional Business) District; Hattiesburg Planning Commission recommended to DENY on August 8, 2007.

4. Take from the table and APPROVE or DENY the matter of the petition filed by Jefcoat Fence Co., Inc. of Hattiesburg, on behalf of Jere D. & Neva C. Jefcoat, owners, represented by Tom H. Eaves, Landscape Architect for certain property located at 5328 Highway 42 (parcels #26-580-2-1&3), to vary from Article 5, Section 87.02 (2) which states that the storage area shall be screened from view of the neighbors and the public by a solid fencing and instead allow screening on existing 8 foot chain length fence; the Board of Adjustments voted to recommend APPROVAL on November 8, 2006.
5. Take from the table and APPROVE or DENY the petition filed by Nhan Thanh Nguyen, owner, for certain property located at 407 Martin Luther King Avenue (parcel #30-488-1-8-B), to vary from Section 53.04 (3), which requires a minimum rear setback of twenty-five (25) feet in a R-1B (Single-Family Residential) District, and instead allow eleven (11) feet, for a variance of fourteen (14) feet, and granting extension as allowed in Section 12.02; Hattiesburg Board of Adjustments recommended to APPROVE on May 9, 2007.

APPROVE or DENY to adopt the ordinance for the petition filed by Mildred Maddox, owner, to change the zoning classification of certain property located at 1331 North Main Street (parcel # 27-428-1-4), from R-1A (Single-Family Residential) District, to B-1 (Professional Business) District; Hattiesburg Planning Commission recommended to APPROVE on September 5, 2007.
7. APPROVE or DENY to adopt the ordinance for the petition filed by Hattiesburg Clinic Professional Association, represented by Donald E. Walker, The Walker Associates, on behalf of Mary Margaret G. Tatum, owner, to change the zoning classification of certain properties located at 200 Arlington Loop (parcel # 13-372-1-2), from R-1A (Single-Family Residential) District, to B-3 (Community Business) District; Hattiesburg Planning Commission recommended to APPROVE on September 5, 2007.

Linda Culpepper, owner, to allow a Use Permit Upon Review for R-4 Uses (multi-family) in a B-5 (Regional Business) District, for certain property located at 1105 West Pine St. (parcel # 30-628-45-4); Hattiesburg Planning Commission recommended to APPROVE on September 5, 2007.
9. Adopt an Ordinance amending Section 9-74.1 of the Code of Ordinances of City of Hattiesburg to increase fees for Special Police/Fire Duty Hourly rate from $27.00 to $32.00.
10. Adopt an Ordinance amending Ordinance No. 2500, adopted 8-16-94, as amended by Ordinance No 2831, adopted 9-16-03, to amend II, of Chapter 11.11(E-1) to increase fees for residential collection and disposal of refuse.
11. Adopt Resolution Authorizing Requisition Number 12 from the Project Fund Construction Account in connection with that certain Loan Agreement dated as of June 28, 2006 by and between the Mississippi Development Bank and the City of Hattiesburg.
12. Establish petty cash funds, effective October 1, 2007 and approve issuance of manual check to each custodian as of October 1, 2007.
13. Approve the following State Holiday Schedule as the City's holidays for Fiscal Year 2007-08 in accordance Miss Code, Section 3-3-8:

14. Declare and approve the purchase of Civil 3D 2008 Standalone License DVD with Subscription as a sole source purchase as provided for in Section 31-7-13 (XVI), of the Mississippi Code of 1972, based on information as per attached letter.
15. Authorize Mayor to execute agreement between the City of Hattiesburg and Blue Cross Blue Shield of Mississippi for city employees' health insurance coverage (Administrative Services Contract and Reinsurance Contract) for the period beginning October 1, 2007 and ending September 30, 2008. (Reinsurance contract is for a period of one year beginning October 1, 2007.)
VI. ROUTINE AGENDA
1. Authorize Mayor to enter into a Service Agreement between the City of Hattiesburg and South Mississippi Business Machines to provide maintenance on equipment located in the Police and Fire Training Academy at an annual cost of $1,073.12.
2. Acknowledge receipt of letter filed by Dr. Michael Gilmore; Joe White, and Bernice Linton on behalf of the Historic Hattiesburg Downtown Association, Melvin Williams, Raylawnie & Al Branch and Wilma Adams, opponents, to appeal the Planning Commission's recommendation to APPROVE the petition filed by Southern Scrap Material Co., represented by Joel Dupre , on behalf of the Estate of Neal B. Stokes & Stokes Distributing Co., owner, to allow a Use Permit Upon Review for I-1 Uses (metal recycling facility) in a B-5 (Regional Business) District, for certain property located at 314 East 3rd St. (parcels # 35-64-1-1 & 9 and parcels #35-292-21-1, 2, 3, & 4); (Hattiesburg Planning Commission recommended to APPROVE with stipulations on 9/5/2007), set a public hearing before Council on October 15, 2007 at 4 PM, and authorize publication of Public Notice setting an appeal hearing.
3. Acknowledge receipt of the 2006 Consolidated Annual
Performance and Evaluation Report for the Housing and Community Development Programs and the submission of the same to the U. S. Department of Housing and Urban Development. {Entitlements}
4. Acknowledge submission of application for Accreditation for membership in the American Zoo and Aquarium Association
(AZA).
5. Acknowledge receipt of a Drainage Release, executed by Greg Auto Sales c/o Greg Merrill, releasing the City from any damages which may occur due to the construction on property located at 2772 Oak Grove Rd, and authorize recording of same.
6. Acknowledge receipt of a Drainage Release, executed by Old Growth Development, LLC, releasing the City from any
damages which may occur due to the construction on property located at #2 Gunnison Drive, Lt 14 and authorize recording of same.
7. Acknowledge receipt of a Drainage Release, executed by Big Buck Sports, LLC, releasing the City from any damages which may occur due to the construction on property located at 6173 Hwy 98, and authorize recording of same.
8. Acknowledge receipt of a Drainage Release, executed by
Bennett V. York, releasing the City from any damages which may occur due to the construction on property located at 155 Crosscreek Parkway, and authorize recording of same.
9. Acknowledge receipt of a Drainage Release, executed by Robert N. Graham, releasing the City from any damages which may occur due to the construction on property located at 127 Carlisle Drive, and authorize recording of same.
10. Acknowledge receipt of Privilege License Report for the
month of August, 2007, from the Tax Department, as per
recommendation.
11. Approve sale of grave spaces per attached memo.
12. Approve Claims Docket for the period ending September 14, 2007.
13. Acknowledge receipt of letter filed by Coral Edelon and Chamberlan Carothers to appeal the Planning Commission's recommendation to APPROVE the petition filed by the City of Hattiesburg for a text amendment to adopt regulations for Registration, Certification and Inspection of Rental Dwellings (Hattiesburg Planning Commission recommended to APPROVE on 9/5/2007); set a public hearing before Council on October 15, 2007 at 4 PM, and authorize publication of Public Notice setting an appeal hearing.
