VI. POLICY AGENDA
1. Take from the Table and Adopt the November 20, 2007 Amendments to the budget for the City of Hattiesburg for the fiscal year ending September 30, 2008; and adopt resolution authorizing publication of amendments for funds in excess of 10% of the original appropriation balance.
2. Adopt Resolution Authorizing Requisition Number 15 from the Project Fund Construction Account in connection with that certain Loan Agreement dated as of June 28, 2006 by and between the Mississippi Development Bank and the City of Hattiesburg.
3. Amend check acceptance policy approved at MB1989-5/618-619 to increase the service charge for returned checks (NSF Fee) to $40.00, and authorize changes as needed to keep the fee in conformance with the District Attorney's office.
4. Authorize Mayor to submit grant paperwork for the 2007 Homeland Security Grant Program.
5. Ratify and confirm the Mayor's appointment of Linda McMurtrey, W4 (replaces David Sheley) for a term (5/12/07 to 5/11/12) beginning 12/04/07 and ending 5/11/12 to the Planning Commission Board.
6. Adopt a Resolution of the Mayor and City Council of the City of Hattiesburg, Mississippi, determining the necessity for and invoking the authority granted to Municipalities by the Legislature with respect to Tax Increment Financing as set forth in Chapter 45 of Title 21, Mississippi Code of 1972, as amended, determining that The Lincoln Center Project is a project eligible for Tax Increment Financing under the laws of the State, that a public hearing be conducted in connection with the Tax Increment Financing Plan, and for related purposes.

1. Acknowledge receipt of the monthly budget report for the month ending November 30, 2007, on permanent file in the City Clerk's Office.
2. Acknowledge receipt of two-bid purchase docket report for period of October 30, 2007, through November 25, 2007, as provided for in Section 31-7-13(B) of the Mississippi Code of 1972.
3. Acknowledge receipt of completed Insurance Service Office Form AW-214 and progress report for the City of Hattiesburg s annual re-certification for the FEMA Community Rating System Program, 2007 (permanent copy with all exhibits on file in the City Clerk s Office).
4. Authorize the Mayor to execute annual maintenance agreement/contract with HP Express Service for the HP Designjet 800ps 42 Printer in the amount of $725.00. (MPO 2007)
5. Authorize publication of Notice of Public Comment by the Department of Urban Development for the Hattiesburg-Petal-Forrest-Lamar Metropolitan Planning Organization as required by the Federal Highway Administration and the Federal Transit Administration (SAFETEA-LU) on the HPFL-MPO Public Participation Plan for transportation planning in the Hattiesburg Urbanized Area. 6. Approve Specifications and Authorize Publication of Advertisement for Various Term Bid Items for Public Services for the period beginning April 1, 2008, and ending March 31, 2009.
7. Approve Specifications and Authorize Publication of Advertisement for term bid Items for the Water Department for the period beginning April 1, 2008, and ending March 31, 2010.
8. Approve Specifications and Authorize Publication of Advertisement for Various Term Bid Items for Public Services, Police Department, Fire Department, Urban Development, and Hattiesburg Zoo for the period beginning April 1, 2008, and ending March 31, 2010.
9. Approve Claims Docket for the period ending October 31, 2007.

1. Adopt Resolution approving the adoption and implementation of the Tax Increment Financing Plan of 2007, Hattiesburg, Mississippi, Big Buck Sports Project.
2. APPROVE or DENY to adopt the ordinance for the petition filed by Dr. Martin Baker, represented by Shows, Dearman & Waits, Inc., John T. Weeks, engineer, to close and vacate a platted, undeveloped, unnamed alley running north/south between Pearl St. and Hardy St. and parallel with North 35th and 36th Ave.; Hattiesburg Planning Commission recommended to APPROVE on November 7, 2007.
3. APPROVE or DENY to adopt the ordinance for the petition filed by John Freeman on behalf of Royce Freeman, owner, to change the zoning classification of certain property located at 104 North 11th Ave. (parcel #28-150-2-7) from R-1B (Single-Family Residential) District to B-3 (Community Business) District; Hattiesburg Planning Commission recommended to DENY on November 7, 2007.
4. APPROVE or DENY the petition filed by George Davis, BTR Investments, owner, represented by Lee Mock, Dungan Engineering, to allow a Planned Residential Development (PRD) in an R-1A (Single-Family Residential) District for certain properties located at 1107 West 5th Street (parcel #s 20-1008-29 & 30); Hattiesburg Planning Commission recommended to APPROVE on November 7, 2007.
5. APPROVE or DENY the plat to subdivide lots filed by George Davis, BTR Investments, owner, represented by Lee Mock, Dungan Engineering, for certain properties located at 1107 West 5th Street (parcel #s 20-1008-29 & 30); Hattiesburg Planning Commission recommended to APPROVE on November 7, 2007.
6. APPROVE or DENY the plat to subdivide lots filed by Ralph Lloyd, owner, represented by Bert Kuyrkendall, P.E., Town Square Design LLC, for certain undeveloped lots located on Avenue B (parcel # 168D-10124-15); Hattiesburg Planning Commission recommended to APPROVE on November 7, 2007.
7. Adopt the November 20, 2007 Amendments to the budget for the City of Hattiesburg for the fiscal year ending September 30, 2008; and adopt resolution authorizing publication of amendments for funds in excess of 10% of the original appropriation balance.
8. Authorize Mayor, City Clerk and City Engineer to sign Subdivision plat of The Cottages of Turtle Creek Phase II and accept the maintenance of streets, storm drains and sewer.
9. Authorize the Mayor to execute four (4) applications for emergency work with the USDA, Natural Resources Conservation Service under the applicable authorities of the Flood Control Act, and as amended by Section 216 of the Flood Control Act of 1950, Public Law, 81-516 (33 USC 701b-1), for Lincoln & Alice Street, River Street, City Park and Convention Center with matching funds to be provided by the City through the 2007-08 drainage improvement budget.
10. Declare and approve the purchase of Fourteen (14) VRM850 Data Radios, Fourteen (14) Ant., and Fourteen (14) Data Cables for the Hattiesburg Police Department as a Sole Source Purchase in the amount of $43,211.00, as provided for in Section 31-7-13 (XVI) of the Mississippi Code of 1972, based on information as per attached letter and memorandum.
11. Acknowledge receipt of Judgment, Cause No. 2006-0324-GN-D, Chancery Court of Lamar County, filed on October 30, 2007, approving Ordinance No. 2910, extending the boundaries of the City of Hattiesburg.
12. Approve and authorize Mayor to execute Cancellation of Lien of Deed of Trust from Waites & Associates Enterprises, LLC to Charles E. Lawrence, Jr., Trustee, City of Hattiesburg, Beneficiary, recorded in Deed of Trust Book 1413 at Page 0421 of the Land Deed Records of the Office of the Chancery Clerk of Forrest County, Mississippi, as per attached Cancellation of Lien of Deed of Trust. {Entitlement}
13. Approve and authorize Mayor to execute Cancellation of Lien of Deed of Trust from Katie Campbell to Charles E. Lawrence, Jr., Trustee, City of Hattiesburg, Beneficiary, recorded in Deed of Trust Book 1493 at Page 0528 of the Land Deed Records of the Office of the Chancery Clerk of Forrest County, Mississippi, as per attached Cancellation of Lien of Deed of Trust. {Entitlement}
14. Authorize and approve execution in triplicate of addendum to Public Service Grant Agreement between The University of Southern Mississippi School of Social Work Family Network Partnership and the City of Hattiesburg Department of Urban Development Community Development Division to amend contract to extend the performance period to December 31, 2007, MB2007-2/333-43. {Entitlement}
15. Authorize and approve execution in triplicate of addendum to Public Service Grant Agreement between The University of Southern Mississippi Institute for Disability Studies and City of Hattiesburg Department of Urban Development Community Development Division to amend contract to extend the performance period to May 30, 2008, MB 2007-2/55-65. {Entitlement}
VI. ROUTINE AGENDA
1. Acknowledge receipt of a letter from State Tax Commission to reject the application for Industrial Exemption for Cloverleaf Mall, LLC.
2. Authorize Mayor to approve the purchase of three (3) canines from South Mississippi Canine Consultants at a total cost of $17,300.00, in accordance with Mississippi State Code 21-21-5, for the Hattiesburg Police Department.
3. Authorize the Mayor to enter into a Service Agreement between the City of Hattiesburg and Owens Business Machines to provide maintenance on a Canon Imagerunner 4570 Digital System Copier located in the Public Services Department at an annual cost of $1,080.00.
4. Acknowledge receipt of sales in the amount of $4,995.00, held on September 7, 2007 and in the amount of $6,885.00 held on September 8, 2007, from Durham Auctions, Inc.
5. Acknowledge receipt of a Drainage Release, executed by
Beverly Smallwood, releasing the City of Hattiesburg from any damages which may occur due to the construction on property located at 105 Meadowood Drive, and authorize recording of same.
6. Acknowledge receipt of a Drainage Release, executed by
Lincoln Road Center, LLC, releasing the City of Hattiesburg from any damages which may occur due to the construction on property located at 2706 Lincoln Road, and authorize recording of same.
7. Approve Specifications and Authorize Publication of
Advertisement for the Willis Terry Tennis Complex Tennis Court Resurfacing.
8. Acknowledge receipt of bids received on September 20, 2007, for the furnishing and install one (1) new single slope building off of existing structure for the Traffic & Construction Department, recommend that the City of Hattiesburg accept and award said bid to Nobles Contracting, LLC in the amount of $47,900.00 as being the only bid received and authorize the Mayor to execute contract for same.
9. Acknowledge receipt of bids received on November 8, 2007, for furnishing and installing a 912' long X 48 tall flat top aluminum industrial grade fence with 40 5' x 48 single gates for the Hattiesburg Train Depot and award said bid to Jefcoat Fence of Hattiesburg in the amount of $42,537.58 as being the lowest and best bid received and authorize Mayor to execute contract for same.
10. Acknowledge receipt of bids received on September 27, 2007, for the construction of the Hattiesburg Police Department Service Center and reject the bids due to bids exceeding the budget and engineering estimate for the project.
11. Acknowledge receipt of bids received on October 11, 2007, for the Static Display Restoration for T-33A, RF-101C and RF-84F at the Hattiesburg Bobby L. Chain Municipal Airport and reject the bids due to bids submitted were not in accordance with the published specifications.
12. Acknowledge receipt of Privilege License Report for the month of October 2007 from Tax Department, as per recommendation.
13. Approve sale of grave spaces per attached memo.
14. Approve Proofs of Publication for the month of October 2007.
15. Authorize and approve issuance of manual check for CDBG Program Claim per attached memorandum. {Entitlement}
16. Authorize and approve issuance of manual check for HOME Program Claim per attached memorandum. {Entitlement}
17. Approve Claims Docket for the period ending November 18, 2007.
