1. APPROVE or DENY the petition filed by Alcus Hudson and John Ervine, owners, to construct a new single-family residence at 310 24th Avenue; (Hattiesburg Historic Conservation Commission recommended to DENY on 1/9/2008).

2. APPROVE or DENY to adopt the ordinance for the petition filed by John D. Norris, Jr., represented by Carey R. Varnado, to close and vacate a portion of Ida St. and a portion of an unnamed alley, both of which are undeveloped, running north/south between Byrd street and Alexander St. (Dixie Pine Road and Lurlyne St. to the east, Ward 5) and parallel with Edwards St.; Hattiesburg Planning Commission recommended to APPROVE on February 6, 2008.

3. APPROVE or DENY the petition filed by Steve Downing- Providence Development Group, on behalf of Patrick (Pete) Johnson, Jr., owner, to allow a Use Permit Upon Review for a group care facility in a R-3 (Multi- Family Residential) District, for certain properties located at 5436 Highway 49 (parcel #63-1076-36F, Ward 5); Hattiesburg Planning Commission recommended to APPROVE on February 6, 2008.

4. APPROVE or DENY to adopt the ordinance for the petition filed by Steve Downing- Providence Development Group, on behalf of Patrick (Pete) Johnson, Jr., owner, to change the zoning classification of certain undeveloped property located at 5436 Highway 49 (parcel #63-1076-36F, Ward 5) from B-2 (Neighborhood Business) District to R-3 (Multi-Family Residential) District; Hattiesburg Planning Commission recommended to APPROVE on February 6, 2008.

5. APPROVE or DENY to adopt the ordinance for the petition filed by Tatum Timber, LP, owner, represented by Joseph F. Tatum, Jr., to change the zoning classification of certain undeveloped properties located at West Pine Street (parcel #s 29-448-3-2 & 4, Ward 5) from B-3 (Community Business) District, to B-1 (Professional Business) District; Hattiesburg Planning Commission recommended to APPROVE on February 6, 2008.

6. Adopt a Resolution requesting the Legislature of the State of Mississippi to extend the enabling legislation of the Hattiesburg Tourism Commission and the special tax levied thereof to September 30, 2013.

7. Adopt Resolution Authorizing Requisition Number 20 from the Project Fund Construction Account in connection with that certain Loan Agreement dated as of June 28, 2006 by and between the Mississippi Development Bank and the City of Hattiesburg.

8. Adopt the February 19, 2008 Amendments to the budget for the City of Hattiesburg for the fiscal year ending September 30, 2008; and adopt resolution authorizing publication of amendments for funds in excess of 10% of the original appropriation fund balance.

9. Authorize execution of Interlocal Agreement in triplicate between the City of Hattiesburg and and Longleaf Trace Rails-To-Trails Recreation District.

10. Authorize execution of Project Agreement in duplicate, Operation and Maintenance Agreement and Assurances Relating To Real Property Acquisition between the City of Hattiesburg and USDA Natural Resources Conservation Service for the Landfill Project and the North Lagoon Site and Authorize City Attorney to issue letter for Title of Opinion on the above projects.The work to be performed has an estimated value of $751,000.00 to USDA and zero (0) cost to Sponsor.

11. Authorize execution of Agreement in triplicate between the City of Hattiesburg and Neel-Schaffer for Professional Services for the Update of the Stormwater Management Program, Years 6-10, and the Implementation of Program Year 6. Cost not to exceed $30,000.00.

12. Authorize execution of Agreement in duplicate between the City of Hattiesburg and Illinois Central RailRoad Company for License For Underground Pipelines, Cables and Conduits for storm drainage crossing Dixie Pine Road. Authorize City Clerk to issue a manual check in the amount of $7950.00 made payable to Illinois Central RailRoad Company.

13. Authorize and approve the repair of the 1500 GPM Water Well at Wesley Medical Center as an Emergency Purchase from Griner Drilling in the amount of $47,782.00 in accordance with Mississippi Code 31-7-13 Section K, 1972.

14. Authorize Mayor, City Clerk and City Engineer to execute an amended Subdivison Plat of Officers Quarters on 2nd Avenue for recording purposes only. No improvements will be maintained by the City of Hattiesburg.

15. Set public hearing before the City Council at 4:00 p.m. Monday, March 3, 2008, to seek public input and comment on proposed amendments to the City of Hattiesburg s 2008 One-Year Action Plan and to the allocation of the City s CDBG Funds, and authorize publication of same.

16. Ratify and confirm the Mayor's re-appointments to the Hattiesburg Tourism Commission as follows:


  • James Ratliff (W1) Term of 5 years starting 11-6-07 and ending 11-5-2012

  • Bonnie Warren (ocl) Term of 5 years starting 11-6-07 and ending 11-5-2012


VI. ROUTINE AGENDA

1. Approve Final Payment to Nobles Contracting LLC in the amount of $28,000.00 for construction services rendered; Approve final acceptance of said project; and Authorize Publication of the Notice of Final Settlement of contract of same.

2. Acknowledge donation from Fred's, Inc. in the amount of Three Hundred Fifty-Eight dollars and Eighty-two cents ($358.82) to the City of Hattiesburg Fire Department to be placed in the Municipal Fire Protection fund to purchase fire protection equipment, etc.

3. Acknowledge receipt of a contribution from Fred's Inc., in the amount of $358.82 to the Hattiesburg Police Department, and authorize monies to be placed in the Hattiesburg Police Department's Forfeiture Fund.

4. Acknowledge receipt of Declaration of Forfeitures from the Forrest/Perry Metro Narcotics Task force forfeiting a check totaling $3,560.00 to the Hattiesburg Police Department, and authorize monies to be placed in the Hattiesburg Police Department's Forfeiture Fund.

5. Acknowledge the receipt of appointment by City Judge Vanessa Jones , of Patrina Harper, as Deputy Municipal Court Clerk.

6. Approve and authorize advertisement of a Public Hearing for review and comment on the Cable Franchise Agreement in compliance with Section 626 of the Cable Act as amended in order to identify future cable-related community needs and interest.

7. Approve Specifications and Authorize Publication of Advertisement for Biometric Fingerprint Reader Systems for the Hattiesburg Police Department and the City Hall Complex.

8. Approve Specifications and Authorize Publication of Advertisement for Dive Equipment for the Southeast One Regional Response Team.

9. Acknowledge receipt of bids received on January 31, 2008 for the Sewer System Expansion at J.M. Tatum Industrial Drive and U S Hwy 49 , recommend that the City of Hattiesburg accept and award said bid to Bush Construction Co.Inc., in the amount of $206,893.58 as being the best bid received and authorize Mayor to execute contract for same.

10. Approve the renewal of taxi permit/badge E-074, to Rebecca Dyal , to drive for Margaret's Motor Cab Company.

11. Acknowledge receipt of Privilege License Report for the month of January 2008, from the Tax Department, as per recommendation.

12. Acknowledge Proofs of Publication for the month of January, 2008.
13. Approve sale of grave spaces per attached memo.

14. Authorize and approve issuance of manual checks for CDBG & HOME Program claims per attached memorandum. {Entitlement}

15. Approve Claims Docket for the period ending February 15, 2008.
